of Matthew Bastone

I have practised as a Quantity Surveyor for more than 30 years. My
professional qualifications are as follows:
Diploma in Arbitration (College of Estate Management)
Fellow of the Royal Institution of Chartered Surveyors
Fellow of the Chartered Institute of Arbitrators
I am, in addition, a member of the Association of Independent Construction
Adjudicators, the Society of Construction Law and the Adjudication Society.
I am also a member of Arbrix and a Liveryman of the Worshipful Company of
Arbitrators. I am immediate past Chairman of the Chartered Institute of
Arbitrators, Thames Valley Branch.
I was educated at Wallington County Grammar School and, subsequently, the
Brixton School of Building (now the South Bank University) and I completed
my professional examinations in 1978. More recently, in 1997, I completed
the College of Estate Management’s Postgraduate Diploma in Arbitration and
was awarded the Robert Jardine Brown prize. I went on to undertake
Fellowship Assessment with the Chartered Institute of Arbitrators and
panel-examination as an adjudicator. In 2006 I passed my panel
re-assessments with the RICS and the AICA.
My early training and experience was gained as an articled pupil with John
Laing, with whom I qualified professionally in 1978. The majority of my
subsequent career in construction was spent with large national and
international contractors, mostly in the UK but with a short spell overseas.
In the 1980’s I spent five years with LRM Contract Services Ltd, a quantity
surveying consultancy with offices in Solihull, London and Worthing. I was
made a Director of the firm and ran their London office for three years
before leaving to return to contracting in 1988. During my time with this
firm I was involved primarily in the valuation of building works, the
preparation of final accounts and claims and the resolution of construction
disputes. I was also a Conciliator on the BEC panel for their guarantee
scheme in which role I facilitated the resolution of disputes involving the
quality and value of building works undertaken for householders.
In 1988 I took the position of Chief Quantity Surveyor with Alfred McAlpine
South and was made a Director in 1990, responsible for business planning and
commercial management, with overall responsibility for the quantity
surveying, accounts and procurement functions of the business.
In
September 1993 I left McAlpine to become Commercial Director of Kier Build
Limited, the national major projects division of the Kier Group.
In January 1996 I left Kier to set up my own practice, Matthew Bastone
Associates, Chartered Quantity Surveyors, providing quantity surveying
services and specialising in the management of construction disputes. In
this capacity I have represented parties in the resolution of a wide
variety of disputes, acting for Employers, Consultants, Contractors,
specialist Sub-Contractors and, occasionally, residential occupiers.
In the course of my career I have gained experience in building and civil
engineering projects of many types, ranging in size from minor works to
major projects of up to £65m in value. As a Quantity Surveyor I was
responsible for the measurement and valuation of construction works and
variations, and for the preparation and settlement of final accounts. I was
also responsible for the resolution of a wide variety of contractual
disputes which involved me, in a number of cases, in the preparation,
negotiation and settlement of contractual claims for disputed final
accounts, extensions of time and loss and/or expense.
I am a qualified arbitrator and an accredited adjudicator, on the panels of
the RICS, the CIArb, the RIBA, the AICA and CEDR. I have been appointed on
more than 180 occasions to adjudicate statutory adjudications under the
Housing Grants, Construction and Regeneration Act 1996, and also a number of
contractual and ad hoc adjudications.
I am an accredited expert witness, on the RICS panel, and over the past 15
years I have provided forensic surveying services and prepared expert
reports in connection with a wide variety of construction disputes,
including, in a number of instances, high-profile multi-million pound
litigation and arbitration proceedings. In addition to reporting on the
valuation of construction works and the quantum of loss and/or expense, I
have, on a number of occasions, provided expert opinion on defects and
remedial works, and claims for reconstruction works and reinstatement costs.
I have given evidence in court, arbitration and adjudication hearings on
eight occasions, including once as a single joint expert.
I do a great deal of continuing professional development and regularly
attend training courses and conferences. I also give lectures and run
training events and, on occasion, deliver papers at conferences on
construction law subjects. |
