Adjudication has changed the way in which the entire industry
deals with its disputes. The growing number of contested
decisions, and the resulting judgments handed down by the courts,
means that those involved - both adjudicators and disputants alike
- should now have a pretty good understanding of the ground rules.
In reality however, many firms have little or no experience of adjudication
and do not have the in-house knowledge to enable them to mount -
or defend - an adjudication effectively. This is a dangerous
position to be in - particularly if you are on the receiving end
of a referral notice and have only a matter of days in which to
assemble your defence.
We have now been involved in a great many adjudications and
have become highly experienced in the procedures, the tactics, and
the law of adjudication. Matthew Bastone is, himself, a practicing
adjudicator on the panels of the RICS, the CIArb and the AICA and
has been nominated to act on more than 50 occasions to date.
